The case 20-01307 was lodged in FIFA DRC and concerned alleged article 12bis of FIFA RSTP with its edition effective at the moment of the dispute. Our principal was the football club. The merits of the case, inter alia, were about the topic well covered by the article published in Football Legal – essentialia negotii. The claimant submitted a document not signed by the club and attempted to claim outstanding payables upon it. Nevertheless, due to the burden of proof the DRC Judge came to the conclusion that the claimant didn’t overcome the threshold of burden of proof considering all the facts at hand. In result, the claim was entirely ejected and our club’s interests – remained protected.
